Sheriff’s Office Sued Over Guardsman’s ‘Unlawful’ Termination

A federal lawsuit alleged an Idaho National Guardsman was improperly fired from his job, says Eric Grover, an LA employment lawyer.

This is precisely why the Uniformed Services Employment and Reemployment Rights Act was put in place; to prevent cases like this from happening. The fired deputy alleges that he was terminated during the time the Act provides for recovery from an injury.

A federal lawsuit alleges the Jerome County Sheriff’s Office improperly treated and terminated an employee who was injured while deployed with the Idaho National Guard. Guardsman Mervin Jones received a knee injury during a deployment to Iraq in 2004, then aggravated that injury in 2008 during a weekend training with his Guard unit, according to a press release summarizing the suit from the U.S. Attorney’s Office.
