Dallas personal injury lawyer educates on premises liability after an aluminum awning collapse on 2 Bridgeport High School students causing one death

Dallas personal injury lawyer educates Texans on what to do if you have been injured on someone else’s property. Yesterday marked a tragic day for two Bridgeport High School students and their families. As reported by WFAA, an awning located at Club Barbells Gym   collapsed on top of two students while they were jogging. The collapsed awning killed one girl and seriously injured the other on Tuesday, August 25, 2009. Leslie Denison, 17, and Rebekah Logan, 17, were struck by the faltering awning when they were jogging on a Halsell Street sidewalk in downtown Bridgeport. The two girls, who were cheerleaders and cross country athletes for the local high school, became trapped underneath the awning when it fell on top of them as they were running past the Club Barbells Gym.

Denison was pronounced dead at the scene of the accident by responding emergency medical services (EMS) professionals. Logan suffered serious facial lacerations when she was struck by the collapsed structure and was transported by EMS crews to John Peter Smith Hospital in Fort Worth for treatment. EMS officials stated Logan was coherent and in stable condition. Police officials said it is unknown what caused the concrete and aluminum awning to collapse. Weather is reportedly not a factor. Investigators are conducting a full investigation into the fatal accident.

When someone has been injured or dies on an individual’s or business’ property, the owner of the structure or property may be responsible for the damages and injuries suffered. Property owners in Texas are responsible for dangerous and hazardous conditions they may know about, should have known about, of failed to correct or warn people. Texans are suspected to use common sense and understand property owners are not responsible for protecting people from obvious injury situations. However, if you or someone you know have been injured on someone else’s property you may have a premises liability claim against the owner and their insurance carrier.

Texans are urged to consider the following if they become victims:

-Seek medical attention immediately if you are injured

-Take pictures (most people have a camera on their phone)

-Names and contact information of any witnesses

-Keep a detailed account of the exact event and witnesses

-If you are injured on a business property consult the supervisor or manager and fill out a report but DO NOT SIGN  the report

-Know the state of Texas has a ….statue of limitations on premises liability claim

When an innocent victim becomes injured on someone else’s property, especially the premises of a business, it is common for an insurance adjuster to contact the injured party. Avoid providing any statements without consulting a Texas personal injury lawyer experienced in premises liability claims. The complexities of property laws in the state of Texas can be confusing and contacting a Dallas premises liability attorney may help you recover from your injuries.
