North Dallas Criminal Defense Attorney, John Helms State laws vary as to whether and how employers can access an individual’s criminal record as part of the hiring process. In some states, employers cannot obtain these records at all. In other states, employers may consider an applicant’s criminal record in their hiring decisions.

Under Texas law, background check reports may not include information about convictions or arrests older than seven years for jobs paying $75,000 or less annually. However, this seven-year limit does not apply to jobs with annual salaries over $75,000. Additionally, some types of security industry jobs are exempt from the seven-year restriction.

Additionally, Texas law allows you to tell potential employers that you have no criminal arrests on your record if your arrest record has been deleted.
