According to the lawsuit filed, Leadpoint Business Services allegedly failed to fully relieve employees of their legally required thirty (30) minutes meal breaks. Employees were also allegedly required to work more than four (4) hours from time to time without being allowed the legally required ten (10) minute rest period. The California Supreme Court defines off-duty rest as time during which an employee is relieved of all work-related duties and free from the employer’s control.
Leadpoint Business Services allegedly failed to provide accurate wages, including payment of minimum and overtime premiums, for the allegedly missed meal and rest breaks. This led to employees allegedly being given false payslips. Corresponding California Labor Code According to Section 226, the employer must provide each of his employees with a written, itemized salary statement, which shows, among other things, the gross salary earned.
