
ABC7NY.com reports that a woman and child have been killed in a boating accident on the Hudson River
The tragic deaths of 7-year-old Julian Vasquez and 47-year-old Lindelia Vasquez after the boat they were on capsized in the Hudson River on Tuesday is heartbreaking. Our hearts are with their families.
The preliminary investigation determined that the 27-foot pleasure craft may have carried more passengers than the boat could safely accommodate. That could be one reason why the boat’s owner was reported to be following him on a jet ski.
In its safety tips, the US Coast Guard warns against overloading: “Do not take more passengers than is designed for a boat. Check the boat’s maximum load rating (if applicable). Do not carry more passengers or more weight than the boat is designed for. Overloading can cause the boat to sit lower in the water, reducing the boat’s stability and greatly increasing the risk of capsizing. In addition, too much weight on one side of the boat can cause the vessel to bottom out and increase the likelihood of capsizing.”
From a legal point of view, if the boat was overloaded, the captain, the owner of the boat and the person or company who rented the boat to that family could be held responsible for this terrible tragedy.
