Recently, the Supreme Court of Pennsylvania made an important ruling relating to injury release forms. The case involved a Pennsylvania woman who suffered a serious injury at a ski resort because of an employee’s reckless conduct. Because of the high cost of her medical care and the suffering the injury caused her, she sued the owners of the ski resort and the employee for damages, even though she had signed a form releasing the company from liability for injuries she might suffer at the resort.

At issue before the Court was whether or not the release could protect the resort and its employees from reckless, rather than merely negligent, conduct. Ultimately, the Court decided that, because reckless conduct is closer to intentional causing of harm than simple negligence, injury release forms cannot protect companies from liability for injuries resulting from recklessness. Consequently, even those who sign a release form may be entitled to pursue compensation if they suffer an injury caused by the reckless actions of others.
