Appeals Court: Man Hit, Killed by Metra Train can be Sued for Injuries

An appellate court ruled that a bystander can sue the victim’s estate for injuries she sustained when he was hit by the Chicago Metra train.

I have to agree with the Cook County judge, and disagree with the appellate court. I do not believe Joho’s estate should be held liable for any damages, because it was seemingly a freak accident. The woman just happened to be in the wrong place at the wrong time, and unfortunately sustained injuries as a result.
