Jersey City Lawsuit: Officer’s widow wants investigation records, $10M

Jersey City, NJ – The widow of an officer who was killed during a raid in July 2009 filed court documents on the week of June 21, 2010, stating she intends to sue the city for $10 million, according to reports from NJ.com. The widow is seeking damages for lost wages and pain and suffering.

The lawsuit claims slain Jersey City Police Detective Marc DiNardo was not properly trained or equipped when he and fellow officers stormed an apartment building looking for two armed robbery suspects on July 16, 2009.

While a claim typically must be filed within 90 days of an incident, a judge can allow late claims for up to a year.

The widow’s attorney has filed a motion to allow the late lawsuit, claiming the delay was due to the widow’s struggle with extreme grief.

The lawsuit also charges that Jersey City has stonewalled the widow because she has not been able to see any investigation report related to the fatal incident. Her attorney explained, “It just goes to show that maybe they have something to hide.”

The judge is to decide on the motions on July 23.

DiNardo was a 10-year veteran of the police force. At 37 he was mortally wounded by a gunshot wound to the face as he and other officers raided a Reed Street apartment. The suspects were wanted for robbery and had already wounded another officer.

Three other Jersey City officers and a Port Authority officer were wounded as well.

DiNardo died of his wounds five days after the incident.

Along with monetary damages, the suit seeks to preserve evidence regarding the shooting, including recordings of radio transmissions during the shootings, investigation reports, videotapes, witness statements and all records pertaining to DiNardo’s service and training.

The documents also seek records related to Hassan Abdus Shakur, the man accused of shooting DiNardo, and his girlfriend, Amanda Anderson. Shakur and his girlfriend were killed in the raid.
