New York, NY – A woman who sought a job as a housekeeper for a Manhattan socialite filed a lawsuit against her potential employer Tuesday, June 15, 2010, claiming the woman demanded for her to take an HIV test in order to get hired, as reported by WPIX.com.
Agnes Cybulska filed the lawsuit against Dana Hammond, a daughter of the Anneberg family fortune, in State Supreme Court in Manhattan. The suit states the woman demanded for the “executive Polish housekeeper” to get tested for H.I.V. Hammond wanted the test done on the basis that she was recently tested after she sat on an “unclean” toilet seat.
Cybulska charges that Hammond grew increasingly aggravated after being asked for a reason behind the test. Hammond further told the woman that she would not hire her unless the test was taken.
Cybulska turned the job down. On top of the H.I.V testing requirement, Hammond demanded nine-hour work days at $150 a day. No sick days, vacation time or health benefits were included. Hammond additionally required the position to supervise apartment staff, clean, run errands and occasionally care for Hammond’s young daughter, according to XWIX.
Cybulska also filed a lawsuit against the employment agency Hammond used to recruit her, Domestic Job Picks. Cybulska claims that after she informed the agency of Hammond’s demand for the test, they claimed she did not fit the job anyways.
The suit states that requesting the test violates the city’s Human Rights Law.
