New York Contraband Sales: 14 stores accused of selling illegal knives

New York criminal attorney news: 14 stores, including Home Depot and Paragon Sports were cited for selling switchblades, gravity knives.

New York, NY – A months-long investigation has found that at least 14 retail stores, including major retailers such as Home Depot, Eastern Mountain Sports and Paragon Sports, have been selling illegal knives, as reported by The New York Times. The announcement of the situation was made by District Attorney Cyrus R. Vance Jr. on Thursday, June 17, 2010.

Of the 14 stores, seven have reached agreements with the district attorney’s office. The agreements consist of pulling all illegal knives from store shelves, forfeiting profits made from the sale of the products and financing campaigns to educate the public on illegal knives. In exchange for the services, prosecutors have agreed to not bring criminal charges against the firms.

The deal came after an undercover operation in which investigators from the DA’s office purchased 43 illegal knives, which were mostly switchblades and gravity knives.

At a news conference Thursday, Vance said, “Clearly, there are a number of stores and individuals who have been brazenly and knowingly violating the law in this area… What makes these knives so dangerous is the ease with which they can be concealed and brandished.”

Carrying switchblades or gravity knives is a crime under New York State law.

Home Depot claimed they did not know the knives were illegal. A spokesman for the company told reporters and others that the company immediately removed the contraband from its shelves in Manhattan after being informed of the situation. Home Depot is currently removing the knives from all locations in the state as well, according to the spokesman.

The other seven stores accused of selling illegal knives have not entered into plea agreements. Prosecutors stated they expect that will soon change though.

Vance reported that he expects the store forfeitures to total almost $1.9 million. A little more than half of the money will go to the city. Some 10 percent will go to the state and the remaining funds will go to law enforcement agencies.

Over 1,300 knives have been surrendered by the accused stores so far.
