Child Sustains Injuries in Swamp Buggy/DUI Accident

/rueziffra.com/Allan Ziffra Personal Injury Attorney/ 10/28/2009

Deputies were called to an incident on Rod & Gun Club Road outside of Fort Myers, Florida, earlier this month in response to a possible DUI-domestic dispute. As the first sheriff arrived on scene, a 58 year old man named Glen Maxey was chasing his ex-wife’s car down the street in his Ford F-350 truck. The deputy stopped Maxey and detained him on suspicion of driving intoxicated because of the man’s slurred speech and the smell of alcohol on his breath. Reports state that Maxey was chasing his wife because he had previously engaged in an argument with her wherein the woman had the final say. Maxey was arrested on DUI charges after he failed several field sobriety tests and refused a breathalyzer.

Unfortunately, after speaking with Maxey’s ex-wife, it came to their attention that one of the former couple’s children was injured just prior to the DUI incident. Maxey put the children in a “swamp buggy” when his ex-wife dropped the youngsters off at his house. Maxey had one of the children on his lap while driving the buggy back to his home. He allegedly began to drive in an erratic fashion, causing one of the children to fall out of the buggy and sustain back injuries. The injured child was treated by emergency personnel at the scene and was later transported by EVAC to a nearby hospital. Reports indicate that the man admitted to consuming some beers at his residence leading up to these events.

Accidents such as these can be easily avoided with the exercise of reasonable care and due diligence. However, an individual’s carelessness, inattention or mere human error frequently results in another person being forced to endure a painful and unpleasant experience. Shall you ever find yourself or the welfare of a loved one adversely affected by the negligence of a third party, consult an experienced and dedicated personal injury attorney so that you will be fully informed of your rights and the ways in which counsel can assist you in bringing the responsible party or parties to justice. As Rue & Ziffra partner attorney David Sweat remarks, “It is so unfortunate to speak with injured parties who need the assistance of legal counsel but have jeopardized their case due to speaking with an insurance adjustor or signing documents prior to consulting an attorney.”
