The U.S. Should Correct the Errors in Handling the Diaoyu Islands

U.S. Errs in Handling the Diaoyu Islands through noncompliance of the Cairo/Potsdam Declaration that has significant affects Asian Americans and global economy.

The JusticeForAsianAmerican.org has good faith belief that the recent Islands dispute in East China Sea has arisen from repeated errors by the United States since 1945 in the end of WW2. Historical records suggest that the Senkaku/Diaoyu Islands were the property of imperial China until the Japanese annexed them after their defeat of China in 1895. Later administered by the United States after 1945, the islands were handed back to Japan in early 1972.

On September 11, 2012, the Japanese Government purchased the Senkaku/Diaoyu Islands from the private owner that has owned the island since 1972. Japan has now “nationalized” the ownership of the islands and unilaterally claiming ownership of the islands. September 15, 2012, Asian Americans, especially Chinese Americans have staged the peaceful demonstration in many cities throughout United States and Canada. This has spread into other cities in Asia and Europe. The majority of 30 million overseas Chinese (outside of Mainland China) having Chinese Ancestry are in opposition to the purchase.

United States is a multi ethnic country, all were either immigrants or the descendants of the early immigrant to the U.S. over the past three hundred years, Asian Pacific Americans, began immigrating to the U.S. in the past fifty years, only Native Americans were local. AAPIs consisted of eighteen (18.2) million people constituting 6% of the total population, 14% of which lived in California. AAPIs are the nation’s fastest growing racial group, growing by as much as 46 percent during the first decade of this century.

U.S. foreign policy and action, as well as, other Asian country’s policies and actions could directly impact the Asian Pacific Americans in U.S., such as, the Japanese Surprise Attack in Pearl Harbor. This strike prompted the U.S.’s internment of 124,000 Japanese Americans in the West Coast of U.S. in WWII. The Chinese Americans and Korean Americans in the U.S. were being questioned about their loyalty during the Korean War. The Vietnamese American were blamed for the Vietnam War. In California, Asian Pacific Americans were living side by side in the same neighborhoods, working side by side in working place, with more than 50% of Japanese Restaurants owned by either Chinese or Korean Americans. Any tension arising from Asia or escalations, even some impractical suggestions from Internet of “Boycotting” could cause a significant inconvenience and financial loss to AAPIs, recent tension already causing lower stock prices of Automobile and the Airline Travel Industries.

History:

1403- Chinese discovered Diaoyu Islands and written in their history books, reports and maps from the 15th century, during the period of the Ming Dynasty. Even writings by Japanese scholars in the late 19th century acknowledged this fact.

1879- The Ry?ky? Province(Okinawa) was annexation to Japan, The monarchy in Shuri was abolished. The deposed king Sh? Tai (1843–1901) was forced to relocate to Tokyo. Ryukyu(Okinawa) people are eager to free itself from Japan after WW2 ended with Cairo Declaration which said all lands must be returned to the original owners.

1895- Japan instigated a sea battle with China, as the result, China lost the war, both countries signed the Treaty of Shimonoseki in April 1895 (included Japan takeover and annexation of Taiwan and surround islands of Diaoyu Islands). The treaty, however, was nullified after Japan lost the WW2 in 1945.

1905- Japan takeover of Takeshima/Dokdo Islands, presaged its annexation of Korea five years later. South Korea took the islands back in the early 1950s and deploys police there. Japan occupied the Korean peninsula for 35 years until the defeat of fascist forces in World War II.

1945-1951- August 6, 1945 Atomic bomb drop to Hiroshima and three days later in Nagasaki. August 15, 1945, the Emperor of Japan convinced the Japanese to surrender unconditionally. On 1951 The Treaty of San Francisco was take place in San Francisco, CA, U.S.A. The Senkaku/Diaoyu Islands and surrounding islands were turn over to U.S. for administration or management, in contradiction of both Cairo Doctrine (11/26/1943) and Potsdam Declaration (7/26/1945). Under the Cairo Doctrine and Potsdam Declaration, all land and colonies occupied by Japan thru force or aggression must return to their previous sovereignty included Senkaku/Diaoyu Islands and Ryukyu Islands (Okinawa). At the end of World War II, Japan was forced to return Taiwan (Formosa) to China, and Beijing has argued that it should have handed the Senkaku/Diaoyu Islands over as well. For administrative purposes the Senkaku/Diaoyu Islands were placed under U.S. control as part of its governance over the Ryukyu Islands. The U.S. was then the occupying power in Japan following the latter’s surrender.

1972- On May 15, 1972, the United States ended its occupation of Okinawa and the Ryukyu Island chain, which included the Senkaku/Daioyu Islands were handed back to Japan without prior consulting with China, although as indicated in official document that Japan only retained the administration and management right and not the sovereignty right, the above arrangement was both objected by China and Taiwan.

What United States should do: 1.) Present the Treaty of San Francisco to review the legality base on both Cairo Doctrine and Potsdam Declaration to International Court of Justice(ICJ) is the primary judicial organization of the United Nations. 2.) The other alternative might be having the U.S. take back the disputed islands based upon the “Treaty of San Francisco” involving the violation of Japan’s “nationalized” ownership of the islands and unilateral claims the ownership of these islands, and then schedule the UN Security Council Meeting and vote from there. 3.) Grant the Impacted Asian Americans standing to file legal Action in U.S. District Court to nullify or challenge the Treaty of San Francisco, since The Treaty took place in San Francisco, California in compliance with legal standing and jurisdiction involving International Law.
