This applies to all forms of pay (salary, overtime pay, bonuses, stock options, vacation pay, and other forms of compensation). Unequal compensation can be justified only if the pay differential is attributable to a factor other than gender or to a fair seniority, merit, or incentive system.
• Title VII of the Civil Rights Act of 1964: This law prohibits employers with at least 15 employees from discriminating against employees on the basis of their sex in all terms and conditions of employment, including pay.
• Lilly Ledbetter Fair Pay Act of 2009: This law clarifies that each paycheck that contains discriminatory compensation is actionable under Title VII of the Civil Rights Act of 1964.
