Baltimore, MD – In an update to a previously reported article titled “Baltimore Maryland Shooting: Off-duty officer shoots at unarmed Marine 13 times,” it has been reported that a prominent civil rights attorney is representing the Marine’s family and plans to file a wrongful death lawsuit. The new information was reported by ABC2News.com.

The Baltimore civil rights attorney told the Associated Press he plans to file the lawsuit on behalf of Tyrone Brown, the unarmed Marine who was shot by an off-duty officer. The attorney expressed that the suit will most likely not be filed until after the criminal case is resolved. The officer is charged with first-degree murder.

The Baltimore Sun recently clarified that Brown had been shot 12 times. It was previously reported by the Baltimore police that Brown received nine gunshot wounds. The officer, Gahiji A. Tshamba, fired 13 shots on the night of Saturday, June 5, after the two men had an altercation outside of a bar.

According to The Baltimore Sun, the defense attorneys for the officer are striking back at the accusations, stating that the officer “did what he had to do.” Tshamba has taken the stance that he put himself on duty in order to respond to a sexual assault.

The defense claims Tyrone Brown sexually assaulted a woman outside the bar, and that the woman swung at Brown. Seeing the incident, the officer confronted Brown and drew his weapon.

Witnesses that were with Brown, along with independent witnesses, claim Brown had his hands up in the air when Tshamba began firing.

The attorney representing Brown’s family won a $105 million judgment for the family of a man shot 21 times by a Baltimore police officer in 2004.
