Vermont drunk driving: School bus driver pleads guilty to 2 misdemeanors

White River Junction, VT – A former Chittenden East Supervisory Union school district bus driver who drove drunk with a bus full of students in January 2010 pleaded guilty Monday, June 1, 2010, in a deal that will result in 18 months of jail time, as reported by The Boston Globe.

Shane K. McBrayer, 30, of Waterbury pleaded guilty to negligent operation of a motor vehicle and driving under the influence of alcohol, both misdemeanors. He had a .134 blood-alcohol content when he drove the Mount Mansfield Union High School boys’ hockey team on a one and three-quarters hour trip to Woodstock.

He was originally charged with reckless endangerment and driving under the influence of alcohol.

Prosecutors learned McBrayer had previous drunk driving convictions in North Carolina and Georgia, prompting them to upgrade the drunk driving charge to a felony. The prosecution was then forced to drop the felony after a records issue arose that would have required further litigation about whether the person convicted in the case was the same Shane McBrayer.

The two drunk driving charges were just two among a list of many citations on McBrayer’s record, which also includes robbery, burglary and disorderly conduct.

The Chittenden East Supervisory Union school district hired McBrayer last September. Co-Superintendent John Alberghini said the district hired him after requesting a records check from the FBI, which never showed a drunk driving case.

McBrayer will serve 30 days in jail in Vermont and then be eligible for transfer to Georgia, where he is currently on probation for a purse snatching, according to authorities.

The incident that spurred the charges occurred on January 23, 2010 after team officials noticed erratic driving.
