Philadelphia criminal trial: Ex-cop charged with first-degree murder, assault

Philadelphia, PA – An ex-Philadelphia police officer will be tried on charges of first-degree murder, aggravated assault, recklessly endangering another person, possession of an instrument of crime and other related counts, for the May 2 shooting death of his brother-in-law, as reported by Philadelphia Daily News.

Municipal Judge Karen Simmons listened to the testimonies of Rudolph Gary Jr’s two surviving victims stating that Gary brought a handgun to a water-gun fight involving adults and children, and used it to kill 22-year-old Howard Williams.

Indira Johnson was shot by Gary’s service weapon. The bullet entered her left leg and broke a bone.

James Felder, 18, suffered a graze wound on his leg as a result of Gary’s shootings.

Gary, who had served less than a year as a police officer, was fired the day after the shootings.

The shooting happened during a neighborhood wide water gun fight that Gary and his girlfriend, Amber Colon happened to drive into. There were at least 10 adults and 10 children playing in the streets with water guns.

Apparently, Colon was accidentally splashed and began to fight with Howard William’ niece. The two men, Gary and Williams attempted to break up the fight, which then turned into a verbal match between them.

Gary went to his truck and pulled out his service weapon, pointing it at the crowd and telling everyone to get back, according to witness testimony.

As onlookers tried to calm Gary, telling him to put the gun down and that children were watching, Gary “screamed he didn’t care.”

He then shot Howard Williams in the neck and chest.

Two witnesses reported Gary shot at Williams after he fell.

Gary’s defense attorney claims he was trying to protect his girlfriend, who was being attacked by the crowd. His lawyer claims “There was a serious confrontation going on out there that day.”

It is not yet clear when Gary’s trial will begin.
