Raleigh NC divorce attorneys discuss a spouse’s legal rights with domestic violence

The number of domestic violence cases in North Carolina is staggering, with 1 in 5 women having been sexually assaulted at some point in their lives, according to the NC Department of Health and Human Services.

Unfortunately, domestic violence occurs across all demographics, virtually changing the lives of spouses and children forever. Removing the battered spouse and children from a violent home can be a confusing and scary time. It is important for an abused spouse to know their legal rights and have an experienced, dedicated team to help initiate the appropriate actions.

In the court system, there are two methods to handle a domestic violence case — civilly or criminally. Under Chapter-50 of the North Carolina General Statutes, a victim of domestic violence has the legal right to seek a domestic violence protective order, which prevents contact by the abuser with the victim or children except under very limited circumstances permitted by the court.
