Raleigh NC divorce attorneys discuss a spouse’s legal rights with domestic violence

The number of domestic violence cases in North Carolina is staggering, with 1 in 5 women having been sexually assaulted at some point in their lives, according to the NC Department of Health and Human Services.

Unfortunately, domestic violence occurs across all demographics, virtually changing the lives of spouses and children forever. Removing the battered spouse and children from a violent home can be a confusing and scary time. It is important for an abused spouse to know their legal rights and have an experienced, dedicated team to help initiate the appropriate actions.

The importance of knowing one’s legal rights is vital in the case of domestic violence in the home. When a marriage partner tries to dominate the other partner emotionally or becomes physically abusive, it becomes a case of domestic violence.

In these types of situations, domestic violence by one spouse against the other carries many major legal implications with regard to custody, child support and alimony issues. In the court system, there are two methods to handle a domestic violence case — civilly or criminally. It is highly recommended that an abuse victim find a knowledgeable family law attorney who has experience in domestic violence issues, in order to be entirely informed about the civil and/or criminal options available against an abuser. Under Chapter-50 of the North Carolina General Statutes, a victim of domestic violence has the legal right to seek a domestic violence protective order, which prevents contact by the abuser with the victim or children except under very limited circumstances permitted by the court.

North Carolina divorce attorneys Stephanie Jenkins and Stephanie Gibbs of the Raleigh law firm of Gailor, Wallis and Hunt, have dedicated their lives to being advocates for the rights of victims of domestic violence and are dedicated not only to assisting them in dealing with acts of domestic violence in the court system but to obtain a fair and equitable resolution of related issues such as custody, child support and alimony in light of the fact that domestic violence has occurred. GWH offers knowledge, skill and experience in the many areas of family law that is second to none.
