North Carolina – A lawsuit has been filed against a trucking company accused of causing a train derailment in North Carolina. According to a report by the Associated Press (AP), the suit, filed against Guy M. Turner Inc. of Greensboro in federal court by Amtrak and CSX, alleges a truck driver blocked the railway without taking safety precautions or warning others that the track was not clear.
The derailment occurred on March 9, resulting in the injury of 55 people. According to the lawsuit the driver of the oversized tractor-trailer that collided with the Amtrak train disregarded safety signs and failed to alert CSX or Amtrax of the potential danger. The suit also accuses the trucking company’s Turner Transfer division of failing to take reasonable safety precautions.
The suit says, “Turner Transfer knew or should have known that its activities were inherently dangerous, but nevertheless failed to take reasonable precautions to avoid injury or ensure that such precautions were taken.”
The truck was reportedly transporting electrical equipment from North Carolina to New Jersey. Witnesses say the driver spent time moving back and forth in the crossing, and jumped out of the vehicle prior to impact.
Damages sought by the plaintiffs in the suit have not been disclosed.
