Los Angeles – A 73-year-old woman was awarded $13 million in a personal injury lawsuit over an asbestos-containing product manufactured by Colgate-Palmolive Co. The woman developed a terminal condition from using Cashmere Bouquet talcum powder according to the case.
The Associated Press reports jurors found Colgate-Palmolive Co to be 95 percent responsible for Judith Winkel contracting the fatal lung disease mesothelioma. The verdict also included a $1.4 million awarded to her husband.
Winkel’s attorney Chris Panatier said of the case, “This is an example of the legal system exposing what a company should have been honest about 50 years ago… Judith Winkel only wanted a jury to hear the truth about this product and hopefully to help others who are similarly exposed.”
Ad noted by the AP, billions of dollars in settlements and verdicts have been paid in legal claims filed on behalf of individuals sickened by exposure to asbestos.
Colgate sold Cashmere Bouquet two decades ago. The company released a statement following the verdict saying, “We believe that the facts and evidence presented at trial showed that Cashmere Bouquet … played no part in causing the plaintiff's illness.”
