Bay Area Employment Lawyer: Worker Sues for Failed Evaluations on Medical Leave

An employee claims he received failing evaluations while out on approved medical leave, reports the Bay area employment lawyer.

It’s hard to imagine how an employee on approved medical leave would receive and fail employment evaluations, says Jeffrey Keller, a Bay Area employment lawyer. The Louisiana Dept of Labor found that performing evaluations during the approved absence was in violation of company policy. The employee contends that it was a wrongful termination and violated the Family Medical Leave Act, among other laws. If the claims are accurate, this employee may have cause for a valid wrongful termination suit.
