Mississippi Clean Water Act: EPA fines company $70,000 for stormwater violations

Blue Springs, MS – On Thursday June 17, 2010, the U.S. Environmental Protection Agency released news that the organization recently settled with the Pontotoc Union Lee Alliance (PULA) for stormwater-related violations of the Clean Water Act. The PULA violated the 1972 act at two of its construction sites in Blue Springs, MS. The organization has agreed to pay penalties of $70,000.
The first penalty is for stormwater violations at the construction site known as Blue Springs Rail Spur. PULA and Eutaw Construction Company, Inc. agreed upon a $40,000 settlement with the EPA.
Furthermore, PULA and L&T Construction, Inc. entered a separate $30,000 settlement with the EPA for stormwater violations at the Blue Springs North Loop Interchange construction site.
The settlements were reached after representatives from the EPA and the Mississippi Department of Environmental Quality found violations during inspections in May 2009. The EPA issued Administrative Orders in October 2009 that required the violators to revise their Notices of Intent for Permit Coverage, change their Stormwater Pollution Prevention Plans, begin inspection programs and address areas of potential pollution.
The firms have complied with the EPA’s orders.
According to the press release, “Polluted stormwater runoff is a leading cause of impairment to the nearly 40 percent of surveyed U.S. water bodies which do not meet water quality standards. Over land or via storm sewer systems, polluted runoff is discharged, often untreated, directly into local water bodies.”
