Vermont State Police trial: Jury gives partial verdict in wrongful arrest case

Brattleboro, VT – A jury trial over wrongful arrest charges for family members of a mentally ill man who was shot to death in a 2006 confrontation with police resulted in a partial verdict on Thursday, June 17, 2010, as reported by Burlington Free Press.

The case involved five Vermont State Police troopers and three civilians. The police were accused of mistreating the family at the scene of the shooting.

Joseph Fortunati was a 40-year-old man at the time of the shooting. The family sued because they were all arrested at a roadblock near the scene of the shooting.

The jury deliberated for approximately seven hours Thursday, and finally rejected a wrongful arrest claim made by Robert Fortunati of Corinth. The decision was in favor of the police.

Judge J. Garvan Murtha was forced to declare a mistrial for the rest of the individuals in the suit though, as the jury was deadlocked as to the decision of Fortunati’s wife and son.
